Dear Madam/Sir,
Please find enclosed HRF-108 titled "Justice at risk: The need for a witness protection programme in India".
The overarching consideration in criminal law is to give the right to fair trial to the accused. It is also to ensure that not only must justice be done, it must be seen to be done. Balanced against the right of the accused is the interest of the State in prosecuting crime and securing best quality evidence from the witnesses. To this end, witnesses are entitled to protection from intimidation, considering the crucial role played by them in the delivery of criminal justice.
A special law on witness protection is urgently needed, especially in light of the Best Bakery case where the vulnerability of the witnesses was revealed recently, owing to the inadequate protection granted to them within our criminal justice system. What is important is that any law on witness protection shall have to consider the needs of all classes of witnesses.
